Terms and Conditions of Your Booking Vacation Rentals, LLC RENTAL POLICIES -TRANSIENT OCCUPANCY RENTAL AGREEMENT We expect your stay to be comfortable, safe and enjoyable and without surprises. These Transient Occupancy Policies (herein Rental Policies) govern your use of units (herein Cabins) represented by Mt Rainier Vacation Rentals, LLC (hereafter MRVR and the property owners (herein OofMRVR)). Please read through these policies when making a reservation. These policies form a Contract with the Guest who makes a Booking, MRVR and the owners represented by Mt Rainier Vacation Rentals, LLC. THIS AGREEMENT (hereafter Form), between the Vacation Rental Guest (hereafter Guest), Mt Rainier Vacation Rentals (herein MRVR) and OofMRVR is made in the City of Enumclaw, County of Pierce, State of Washington. This Form must be accepted by the Guest as “agreed to” and such acceptance shall be on file with MRVR prior to the release of keys to the Guest. On file may include a written statement of agreement in the form of an email. Once guest occupies the property, Guest will be asked to sign this document. 1. Mrvr represents private Owners of Cabins (herein OofMRVR: Owners) who make their properties available for guest use under contract with Mt Rainier Vacation Rentals, LLC (MRVR). MRVR will make Owners aware of Bookings immediately. Owners may accept or reject a reservation request within 24 hours of notification. All properties made available through Mt Rainier Vacation Rentals, LLC are privately owned and MRVR and OofMRVR reserve the right to refuse service to anyone. MRVR shall not be responsible or liable for accidents or injury to guests or any loss of valuables of any kind while renting an Owner’s property. MRVR reserves the right to evict violators of policies without refund. 2. GUEST – The Guest Booking a Cabin warrants they are at least 21 years of age and that by phone, email or online form they did book the Cabin which has been confirmed by the Booking Confirmation Form (Confirmation). Guest confirms they have read the confirmation form advising of these Rental Policies and on behalf of themselves and their invitees agree to abide by these Rental Policies-Transient Occupancy Rental Agreement (Rental Policies) and other specific instructions and directions specified by each individual Owner. 3. CABINS – Owners grant Guests the right to use the named Cabin(s) except areas locked off or labeled owner supplies. All properties are supplied with linens, (pillows, blankets and bedspreads) and kitchen/cooking utensils. In some cases a sleeper sofa, a futon or a cot may also be supplied. Some properties have bunk beds. The exact configuration may vary before the first date of occupancy. There will be adequate sleeping accommodations as confirmed, but not necessarily for the exact configuration mentioned at time of confirmation. A guest accepts the Cabin and understands that OofMRVR cannot make alterations after check in to the Cabin in order to accommodate unique Guest needs. 4. ADVANCE LODGING – Unless otherwise indicated the Booking is an “Advanced Lodging Reservation” as governed by Visa/MasterCard or American Express Terms & Conditions. Barring problems beyond Owner’s control, Owner agrees to provide the cabin to the Guest and Invitees on the dates indicated. In return, Guest and invitees agree to the Booking confirmation and Rental Policy Terms. The Booking can only be canceled 45 days (60 days during holiday periods) or more prior to check in date to a third party at equal or better rates with a Guests written request. If OofMRVR is able to sell 5. LAST MINUTE SPECIALS - As a last minute special, single nights may be available. A single night is more likely available mid-week. Please feel free to inquire. For your safety and the safety of the next guest, a standard sanitization fee (Cleaning see #11) will apply to all single night booking s as well as multiple night bookings. 6. EARLY CHECK-IN/LATE CHECK-OUT Guests accepts the Cabin "As-is” and may not begin occupancy prior to the Start Date and Check In Time of 4:00 PM and will exit the Cabin no later than the End Date and Check Out Time of 10:30AM. Guest will call MRVR from cabin phone for both Check IN and Check Out. Earlier or Later occupancy may result in additional charges. 7. BOOKING CHANGES – All changes to a Booking is subject to a $50 administration fee. 8. INVITEES - Unless otherwise agreed in writing, the Booking Agreement is only for the use of the Guests family members and specified friends (Invitees). Guest must disclose the total number of adults and minors who will occupy the cabin during the booking. 9. GUEST REGISTRATION- 10. CREDIT CARD PAYMENT Guests who choose to pay with credit card may be required to pay a portion of the credit card processing fee charged by Visa, Master Card or American Express. 11. CLEANING - Guest agree to keep the Cabin clean and in good order during occupancy. Guest agrees to leave the Cabin in the same condition it was at Check-In except for re-sanitization of hard surfaces, vacuuming and laundering used linens. Every Cabin Use requires a sanitization prior to the next guest use. This sanitization fee will be charged at the time of Booking depending on number of guest and length of stay. Further; a. A cleaning/sanitization fee (hereafter Cleaning Fee) shall be charged directly to every booking in addition to the Use Fee. This fee sanitizes the property for the next guests. When additional cleaning is required, MRVR will pass along additional charges to the Guest for excessive post-use cleaning at a rate of $50/hour ($50 minimum) defined as greater than normal cleaning required to return the property to the same condition it was presented at the time of Check-In. b. MRVR will arrange a private housekeeping service to launder the used linens and to sanitize a property before each Guest’s arrival. This sanitization will include; 1.) Laundering the used linens and replacing them as they were upon Check-In. 2.) Sanitize kitchen counters, appliances, fixtures, floors and other hard surfaces. 3.) Sanitize bathroom floors, fixtures including toilet and shower and other hard surfaces. 4.) Vacuum carpeted areas. 5.) Dust all surfaces as needed. 6.) Damp mop/dust mop and clean all hard floors. c. Guests may request additional cleaning service as part of their Booking. Guests requesting cleaning during their stay will pay for that cleaning at the time of registration. d. Rental agreements longer than 30 days require a weekly cleaning. Guest will pay for weekly cleaning fees for the rented property at the time of the Booking. e. The Cleaning Fee does not include the following housekeeping chores. If these chores are left unattended to the cost of completing these chores will be passed onto the Guest through the damage deposit hold at a rate of $50 hour ($50 minimum) 1.) Removing trash from Cabin to the provided receptacles outside the Cabin 2.) Emptying the dishwasher 3.) Separating recyclables according to the message on top of the recycling bin including NOT putting glass in the recycle bin. 4.) Laundering and remaking up beds beyond the registered number of Guests 5.) Washing and putting away dishes including dishes left in dishwasher 6.) Cleaning up trash over flow from outside receptacles 7.) Draining, cleaning and refilling spa as a result of negligent guests use 8.) Cleaning spots left on the carpet especially when pets are included 9.) Cleaning up excess trash left in and around the property 10.) Other housekeeping chores resulting from other than normal daily use. 12. DAMAGE DEPOSIT/OVERAGES Guest will provide a credit card number on which up to $1000 deposit can be held until 10 days after Check Out for damages/overages, excessive utility usage and excessive cleaning requirements as a result of the guest’s stay. An inspection will be conducted within three days of check out. If charges are made resulting from damage, the guest will be notified as soon as possible. Guest may request an inspection with MRVR at the time of check out to mitigate damage and excessive clean charges. In addition to the charges on the Confirmation and the Registration, Guest agrees to pay for any expenses incurred or caused by Guest during their stay (hereafter Overages). Such Overages may include, but not be limited to;
P. Loss of a parking pass will be charged the full cost of that parking pass including administration to replace the pass for example: Crystal Mt. Parking Pass $500, Forest Service Pass $50, Snow Park Pass $60 Handling charges will apply to all such costs. MRVR will make an honest appraisal of such expenses within 10 days. MRVR is authorized to charge an approximate amount and make adjustments to reflect the actual charges within 30 days. 13. AMENITIES Cabin use fees apply only to occupancy of the Cabin and use of the basic features of the cabin selected. For the 14. ENTRANCE- Because this property is rented for short term lodging, OofMRVR or employees of MRVR may enter the cabin with or without notice, for the purpose of inspection, retrieving registration forms, maintenance, cleaning, rental or purchase showings, or any other purpose OofMRVR/MRVR deems necessary. When entering, OofMRVR/MRVR will loudly announce themself and allow guests sufficient time to respond. With no response employee will enter gracefully. 15. LOST AND FOUND - Since Cabins do not have Guest Safes; Guests agree to make provision for storage of valuables and will not bring valuable items of personal concern. Neither MRVR nor OofMRVR will accept responsibility for loss of articles left in the Cabin. MRVR retains articles found in the Cabin for a period of 30 days. MRVR will make every effort to contact last Guest. Guest may contact MRVR to identify and claim articles left behind. Identified articles will be shipped at 16. CABIN UTILITIES - Short term guests (less than 15 days) are not responsible for charges for heat, electricity, water, sewer, garage or other utilities. This includes normal and usual maintenance, taxes or other operating costs unless usage of utilities is considered beyond the usual number of guests. 17. CANCELLATION POLICY Cancellations must be made 46 days prior to Check-in during regular periods and 61 days during holiday periods. The applicable portion of the cancellation policy is dependent upon the time of the cancellation: (1) If a reservation is canceled before the 46 day period prior (and before 61 days for holiday periods) to check-in date, a cancellation fee of $100 and the reservation will be completely cancelled. (2) If a holiday reservation is canceled before the 61 day period prior to a holiday check-in date, cancellation fee of $150 and the reservation will be completely cancelled. (3) If a reservation is canceled 45 days or less (60 days or less for holiday periods) prior to check in, all of the funds collected are forfeited unless the Booking can be Resold (see below). (4) Any Booking change for any reason will incur a $50 Re-Booking administration fee. 18. TRAVEL INSURANCE – Once the confirmation date has passed, cancelled bookings cannot be refunded to Guest for any reason. It is suggested Guest purchases Travel Insurance to cover the cost of this Booking and other travel costs. Refunds are not available due to any circumstances including but not limited to travel delays, weather considerations, event cancellation or mountain access problems. Because we are such a small business Guests should consider vacation rental insurance. UNAVAILABILITY - In the event that the Cabin becomes unavailable for whatever reason (such as fire, water damage, Owner remodeling, change of zoning or taxation rules, OofMRVR’s sale of the property, termination of MRVR agreement, or any other unfortunate reason) MRVR may cancel the Booking and return Guest payment in full, or may transfer Guests payment to a comparable or better Cabin of MRVR choosing. 20. TERMINATION - MRVR reserves the right to immediately terminate the Booking and occupancy of all Guests and Invitees without notice in the event that MRVR believes the 21. EARLY DEPARTURES - Every effort will be made to provide comfortable and adequate lodging for all Guests. If a Guest or their invitees are uncomfortable in a property Booked, MRVR will make reasonable efforts to ameliorate the discomfort or offer to move Guest to a more satisfactory property. If a Guest selects to be moved to another property the Guest will also pay a Cleaning Fee for the second property. Guests leaving their Booking before their Check-Out date due to their dissatisfaction no refund will be available. 22. GUEST OBLIGATIONS Guests and invitees shall abide Policies and follow owner instructions provided in each Cabin. OofMRVR will provide such instructions in writing for each guest: (1) Guests and their Invitees will use the Cabin for Invitees such as family, extended family and friends and for no other purpose without prior written notice of such use. Guest will not host parties, host groups or conduct gatherings that increase occupancy to greater than the Maximum Occupancy signed for at Registration. Guest and Invitees will properly use and operate the electrical, gas, heating, air condition, plumbing, fixtures, furnishings, spa and amenities. Guest will vigorously enforce NO SMOKING, NO PETS (unless authorized) and NO NOISE. (2) Guests and Invitees will not do or permit anything in or about the premise which will obstruct or interfere with the rights of OofMRVR, Law Enforcement, neighbors or other guests or injure or annoy them or use or allow the premises to be used for any improper, immoral, objectionable purpose, nor will Guest cause, maintain or permit any nuisance in or about the property. Guest or their invitees will not operate any equipment in the Cabin unless approved by MRVR. (3) Guests and their Invitees shall not destroy, deface, impair or remove any part of the Cabin, its appurtenances, facilities, equipment, furnishings, appliances, or fixtures. (4) Guests and their Invitees will not make copies of keys or reveal key codes to any other persons under any circumstances. (5) Guests and their Invitees will return all furniture, kitchen and dining utensils, appliances, books, phones, recreational equipment to their condition at the time of check-in. (6) Guests and their Invitees will leave all TV remote controls, garage controls and other non-fixed equipment in their original locations. 23. CREDIT CARDS - Guest warrants that Credit Card (Card) information is correct, that the card has available credit for charges, a $1000 Damage Deposit and overages and that the Card will not be cancelled or charges disputed with Guest’s Credit Card issuer. Should the Guest Card expire or be terminated while charges are outstanding, guest will provide MRVR with the name, number and expiration date of a replacement card that can then be used for Guest Charges. Resolving a credit card issue will be billed at $75 for administration charges. 24. SUNDRIES - For all cabins, OofMRVR provides a reasonable supply of sundries such as paper towels, toilet paper, coffee filters and sufficient kitchen supplies including dish and dishwasher soap sufficient for number of guests that can sleep in each property. Personal supplies such as shampoo, body wash, sunscreen, toiletries, food, and toothpaste shall be provided by guests. 25. SMOKING - A No Smoking policy allows for your comfort and the comfort of others. The No Smoking policy applies to the inside of the Cabin and outside in the surrounding property related to the cabin. 26. PETS Some Owners allow pets. However, without prior arrangement, the general NO PET policy allows for the comfort of others. A specific Pet Policy will be provided for Guests with pets. 27. STATE LODGING TAX - Rates are subject to change as set by the WA State Department of Revenue. 28. HOT TUBS - Sanitization- Guests shall not remove the sanitation floater provided in each hot tub. Guests shall not put additives such as bubble bath, bath oils, and etc in the hot tub. Guest agrees to shower prior to entering a hot tub to remove body lotion and oils that may seize and render useless the chemicals used to sanitize the water for Guest safety. Guests shall not use glass beverage containers in or around the hot tub. Guest agrees to thoroughly clean any spills caused by the use of beverages, food or candles in the area surrounding the hot tub. An additional fee of $100 will be charged if Guest and/or their Invitees use of the hot tub results in the need to change out the water because the chemicals have been rendered useless by Guest’s misuse of the hot tub. 29. HOT TUBS – Risk of use – Guests realize using a public hot tub comes with inherent health risk. While every effort is made to sanitize the water in the hot tub, Guests accept the personal risk in using the hot tub. Body oils, lotions and/or detergents in swim suits may affect the chemical balance of any hot tub. Feel free to monitor chemicals yourself to insure your good health before entering a owner maintained hot tub. Chemical monitoring sticks are available in each Cabin for your use. If you have any questions, please contact MRVR at 360 663 2625. 30. CHECK-IN CONDITON - MRVR strives to maintain the cabin and furnishings, equipment and amenities in the finest condition. We are grateful for the vast majority of our guests who are considerate, careful and appreciative of our high quality standards and support us in maintaining the condition of our rentals. Guests are encouraged to report any concerns regarding questionable damage or cleanliness at the time of Check-in. 31. PROPERTY SALE - On rare occasions a property may be sold prior to your arrival. OOFMRVR will inform you of the sale of a property you may have booked, offer you a refund or a comparable property (as available) for your stay. Neither OofMRVR nor MRVR bears any further responsibility. 32. HOLD HARMLESS DUE TO EVENTS THAT ARISE FROM NATURALLY OCCURING HAZARDS AND UNFORESEEN AND/OR UNPREDICTABLE OCCURRENCES Guest is hereby alerted to the fact that certain hazards, and unforeseen and/or unpredictable occurrences are inherent with geographical location of the Upper White River Valley, including but not limited to those that arise from weather, altitude and/or being the natural habitat of wild animals. It is the Guest's responsibility to familiarize themselves with such possible occurrences. Further, MRVR shall not be held responsible for any latent defects within or without the rental property that are beyond the scope of a diligent search for such defects. Guest agrees to hold MRVR and/or its agents harmless in the event of any damage or injury to self or property, or to any additional persons staying with the Guest during this rental or any other person whomsoever in connection with the rental of the property that results from accident, injury, any effects of snow, ice, flood, defective construction, fire, theft, injury caused by contact with animals, and the like. MRVR also shall not be liable for any error of judgment or for any mistake of fact or law, or for anything which it may do or refrain from doing hereunder, except in cases of willful misconduct, or gross negligence.
